Starting the Process

The earlier you start the process the better, as sometimes it can be a month from when you apply until your hearing, especially in the busy spring and early summer months.

Detailed Process

  • Get the Notice of Intent, WPA Form 3 and the NOI Applicant Checklist (PDF).
  • Make an appointment with the conservation staff at 508-532-5460 to receive other forms that you need to fill out.
  • Make nine copies of the forms (no bindings) and plans (folded) as described in the checklist. Submit eight of these to the Conservation Office and mail the last packet to the state. You will then be given your hearing date and time. Hearings are usually held on the 1st and 3rd Wednesday evenings of each month. The state will issue a file number for your project.
  • Notify your neighbors at least 7 business days before your hearing. These days do not include the night of the meeting, weekends and holidays. The Conservation Office will give necessary forms to the applicant.
  • Site Visit - A pre-hearing site visit will be held on the Friday before the hearing. These typically start at 9 a.m. A few commission members may attend. This will be attended by an Agent of the Commission. The pre-hearing site visit may be canceled due to inclement weather.
  • Attend the hearing. Submit proof of notification to abutters (neighbors generally within a 100-foot radius of the property) to Staff at the hearing, as well as an Affidavit of Service.
